By accessing or using NudgePrompt ("the Service"), you agree to be bound by these Terms of Service. If you do not agree, do not use the Service.

2. Description of Service

NudgePrompt is an AI-powered prompt engineering tool that helps users generate optimized prompts for use with AI models. The Service includes free and paid subscription tiers with varying usage limits.

3. Account Registration

You must create an account to use the Service. You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You must provide accurate and complete information when creating your account.

4. Subscriptions and Payments

Paid subscriptions are billed monthly through Stripe. By subscribing to a paid plan, you authorize us to charge your payment method on a recurring basis.

• You may cancel your subscription at any time through your account settings.
• Cancellation takes effect at the end of the current billing period.
• Refunds are not provided for partial billing periods.
• We reserve the right to change pricing with 30 days notice.

5. Acceptable Use

You agree not to use the Service to:

• Generate content that is illegal, harmful, threatening, abusive, or otherwise objectionable.
• Attempt to bypass usage limits or access controls.
• Reverse engineer, decompile, or disassemble the Service.
• Use automated means to access the Service beyond the provided API.
• Resell or redistribute the Service without authorization.

6. Intellectual Property

Prompts you generate using the Service are yours. You retain ownership of your input and the resulting output. NudgePrompt retains ownership of the Service, its design, code, and underlying technology.

7. Disclaimer of Warranties

The Service is provided "as is" without warranties of any kind, whether express or implied. We do not guarantee that the Service will be uninterrupted, error-free, or that generated prompts will produce specific results with any AI model.

8. Limitation of Liability

To the maximum extent permitted by law, NudgePrompt shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly. Our total liability shall not exceed the amount you paid us in the 12 months preceding the claim.

9. Termination

We may suspend or terminate your access to the Service at any time for violation of these Terms. Upon termination, your right to use the Service ceases immediately. Provisions that by their nature should survive termination will survive.

10. Changes to Terms

We may update these Terms from time to time. We will notify you of material changes by posting the updated Terms on the Service. Continued use after changes constitutes acceptance.
